2. Guidelines for Local Guides, Vendors, Tour Suppliers, Fytrips Agents, and Partners

Originality of Content:

Only upload 100% unique content that is not copied from any other source.

If similar content exists on your own website, you must provide substantial proof of ownership. Alternatively, consider rewriting the content (structure may differ, but the intended meaning should remain intact). Fytrips may offer assistance with content rewriting if required.

Execution of Tours/Experiences:

The tours and experiences you list must be conducted by you or your company. Outsourcing the execution to third parties is not permitted. By uploading your tour or experience, you confirm that you will be the party conducting it in its entirety.

Media Ownership:

You must own full rights to any media (images, videos, slides, marketing material, etc.) uploaded on the Website.

Fytrips reserves the right to use such media for promotional purposes without providing attribution, unless otherwise agreed in writing.

Copyright Ownership:

You must have sole and complete copyright ownership of all information and media uploaded.

Do not upload any content that you do not own or for which you lack full ownership rights. Use of any content licensed under Creative Commons or similar licenses is strictly prohibited.

Accuracy and Consistency:

Ensure that all images and written content accurately reflect the tour or experience being offered. Any mismatch or intentional misrepresentation will result in the removal of the listing and may lead to a permanent ban from Fytrips.

Responsibility for Infringement:

By submitting your tour/activity details, you accept full responsibility for any copyright infringement issues related to the material provided.

Fytrips conducts random checks, but the ultimate responsibility for ensuring original content lies with you.

3. Process for Copyright Claimants

If you believe that any content on [fytrips.com] infringes on your copyright, please follow the process below:

Provide Detailed Information:

Submit an email outlining the specific experience or tour that you believe infringes your copyright.

Include the exact permanent URL(s) of the page(s) containing the allegedly infringing material and specify which part of the content is in violation.

Proof of Copyright Ownership:

Supply evidence demonstrating your ownership of the copyright for the material in question. This may include, but is not limited to:

Proof of registration under relevant copyright laws or the DMCA.

Detailed information about the creation of the material (e.g., where and when the photograph was taken, by whom, and the subject matter).

Review and Action:

Upon receiving a copyright claim, Fytrips will forward the details to the vendor responsible for the content.

• The vendor will have up to seven (7) business days (which may be extended to fourteen days) to respond.
• If no satisfactory reply is received within the timeframe, the infringing content will be removed, and the vendor may be banned from further listing on Fytrips.
• In cases where the vendor’s reply is inconclusive or they fail to prove ownership of the material, the content will be removed immediately, and the vendor will be held responsible for the infringement.

False Claims:

Intentionally false claims or misrepresentation of facts will result in Fytrips taking legal action against the claimant, which may include liability for damages, costs, and attorney fees.

4. Additional Provisions

Content Display and Promotion:

By submitting your listing on the Website, you consent to its display in the Fytrips marketplace and on any of our associated websites.

You also grant Fytrips the right to use your content for promotional purposes.

Content Exclusivity:

Textual content uploaded to [fytrips.com] should not be republished or copied to any other website for a period of six (6) months after the tour or experience is active on our Website.

While you are free to use other marketplaces or websites, the content must remain exclusive to Fytrips for the specified period.

Watermarking:

Content provided may be watermarked by Fytrips to prevent unauthorized use or piracy.

Jurisdiction:

Fytrips India Private Limited is registered in Jaipur, India. All legal disputes, including those related to copyright violations, shall be subject to the jurisdiction of the courts in Jaipur, Rajasthan.

Final Authority:

Fytrips holds the right to delete any content from the Website at any time, and its decision shall be final.
